A federal law called the Real Estate Settlement Procedures Act (RESPA) entitles the individual homeowner to choose a title insurance company when purchasing or refinancing residential property. Typically, homeowners don’t make this decision for themselves, instead relying on their bank’s or attorney’s choice; however, the homeowner retains the right. RESPA makes it unlawful for any bank, broker, attorney or seller to mandate that a particular NJ title insurance company be used. Doing so is a gross violation of federal law and any person or business doing so can be heavily fined or lose its license.

Specific Hoboken Title Insurance related Information:
The City of Hoboken Tax Collector office is located in the City Hall building at Washington Street. In addition to collecting taxes within the city, the department is also responsible for collecting and disbursing money for the payment of claims of the City of Hoboken. We as your Hoboken Title Company will be obtaining a certification prior to closing which will allow all fees to be prorated amongst buyer and seller.
The Tax Office will send One Tax Bill that shows (4) Quarters and the due dates.
The tax bill you receive will show the amounts due for August and November of 2013. It will also include the amounts due for February and May of 2014. Please do not disregard this bill after the August payment. Use this bill to pay the November, 2013, February, 2014 and May, 2014.
The Quarterly Tax due dates are as follow:
◦Third Quarter – August 1st – August 12th, 2013
◦Fourth Quarter – November 1st-12th 2013
◦First Quarter – February 1st-10th 2014
◦Second Quarter – May 1st-12th 2014

When preparing for a settlement as a Hoboken Title Company we work directly with the Hudson County Recorder of Deeds to properly record the transfer and mortgage documents in the county clerks office. It should be noted that PURSUANT TO N.J.S.A. 52:27d-287a., et seq. THE HUDSON COUNTY BOARD OF CHOSEN FREEHOLDERS, BY RESOLUTION DATED JANUARY 29, 2010 (#46-1-2-10) ESTABLISHED THE “HUDSON COUNTY HOMELESSNESS TRUST FUND” WHICH AUTHORIZES THE COUNTY TO IMPOSE A THREE DOLLAR ($3.00) SURCHARGE FOR ANY DOCUMENT RECORDED IN THE COUNTY, WITH THE EXCEPTION OF ASSIGNMENTS OR SUBSTITUTIONS OF PREVIOUSLY RECORDED DEEDS OF TRUST. THIS SURCHARGE SHALL BE USED EXCLUSIVELY FOR THE “HOMELESSNESS TRUST FUND”.
